Misdemeanors are less serious than felonies but can still result in fines, probation, jail time, and other consequences that affect your life. Jared Isaacson provides experienced defense tailored to the specific circumstances of your misdemeanor charge.
The classification of a misdemeanor generally determines how serious the offense is and the potential consequences that may follow.
A simple misdemeanor is a lower-level criminal offense, but a conviction can still mean jail time, fines and a criminal record. Common examples include disorderly conduct, minor theft, trespassing and public intoxication.
Gross misdemeanors are more serious offenses that carry greater potential penalties than simple misdemeanors. Depending on the charge, they can involve up to nearly a year in jail and higher fines, with offenses such as DUI, domestic violence and stalking falling into this category.
A misdemeanor case can turn on details that aren’t obvious from a police report or the initial evidence. Jared digs deeper to understand what actually happened and find the facts that can change how your case is defended.
Jared doesn’t stop at reviewing the evidence; he investigates the circumstances surrounding your case to uncover details that may have been missed or overlooked.
Jared visits the scene, talks to witnesses and examines details to understand the full picture, and not simply work from someone else’s version of events.
Jared uses what he uncovers through investigation to develop a defense grounded in the facts of your specific case.
Going to trial is one option for responding to a misdemeanor charge, and the decision depends on the evidence, potential penalties, and circumstances of your case.
A trial gives the defense an opportunity to question the prosecution’s evidence and challenge whether it proves the charges.
Depending on the circumstances, going to trial may offer an opportunity to avoid a conviction and the consequences that can come with it.
If the prosecution cannot prove the case beyond a reasonable doubt, the defendant may be found not guilty.
Depending on the circumstances of your case, there may be ways to resolve a misdemeanor charge without going to trial.
A plea agreement may allow you to plead to a lesser charge or receive reduced penalties.
Your lawyer may file a motion to dismiss when legal or evidentiary issues provide grounds for the charges to be dropped.
Eligible defendants may be able to complete requirements such as counseling or community service in exchange for having the charges dismissed.
A misdemeanor trial follows several steps, from selecting the jury to presenting evidence and reaching a verdict.
The court selects jurors who will hear the evidence and decide the case.
The prosecution and defense outline their respective cases for the jury.
The prosecution presents its evidence, while the defense challenges it and may present evidence of its own.
Both sides summarize their cases and explain why the jury should reach their requested verdict.
The jury considers the evidence and reaches a verdict of guilty or not guilty.
If the defendant is found guilty, the judge determines the sentence based on the applicable law and circumstances of the case.
